1. INTRODUCTION AND SCOPE

Integex Solutions Inc., doing business as AutoFunds (“AutoFunds,” “we,” “us,” or “our”), provides a cloud-based software platform for licensed automobile dealerships, lenders, and authorized service providers operating in the United States. This Privacy Policy describes how we collect, use, disclose, and protect information in connection with our platform located at www.autofunds.com, our mobile applications, and related services (collectively, the “Platform”).

This Privacy Policy applies to: Dealer principals, dealership employees, and other authorized users (“you” or “Users”) who access and use the AutoFunds Platform.

This Privacy Policy does not apply to: Consumer data collected through dealer-hosted websites built or managed through the AutoFunds Platform. Dealers are responsible for maintaining their own consumer-facing privacy policies for their websites. AutoFunds’ role with respect to consumer data processed through the Platform is described in Section 5 of this Policy and in the Data Processing provisions of our Terms of Use.

By accessing or using the Platform, you acknowledge that you have read and understood this Privacy Policy. If you do not agree, you must discontinue use of the Platform.

2. INFORMATION WE COLLECT

We collect information in three ways: information you provide to us, information collected automatically, and information received from third parties.

2.1 Information You Provide

When you create an account, use the Platform, or communicate with us, you may provide:

  • Account information: Name, email address, phone number, dealership name, dealership address, dealer license number, job title or role.
  • Billing information: Credit card or debit card number, billing address, and related payment details. Payment card data is processed by our third-party payment processor and is not stored on AutoFunds servers in unencrypted form.
  • Support communications: Content of emails, chat messages, phone calls, and support tickets submitted to our customer support team.
  • User content: Data you enter into the Platform, including vehicle inventory information, deal records, customer records, financial data, and documents.
  • Consumer data you submit: In the course of using the Platform, you may enter personal information of your customers (“Consumer Data”), including names, addresses, phone numbers, email addresses, Social Security numbers, dates of birth, driver’s license numbers, credit application data, income information, and employment details. AutoFunds processes this data on your behalf as a service provider/data processor as described in Section 5.

2.2 Information Collected Automatically

When you access or use the Platform, we automatically collect:

  • Device and browser information: IP address, browser type and version, operating system, device type, device identifiers, screen resolution, and language preferences.
  • Usage data: Pages visited, features used, clickstream data, session duration, timestamps, referring URLs, and interactions with Platform elements.
  • Log data: Server logs recording access times, error logs, API call records, and authentication events.
  • Cookies and similar technologies: We use cookies, web beacons, pixels, and similar tracking technologies as described in Section 4.
  • Location data: Approximate geographic location derived from IP address. We do not collect precise GPS location data.

2.3 Information from Third Parties

We may receive information from:

  • Credit bureaus and data providers: When you use credit bureau integrations through the Platform (e.g., 700Credit, DealerTrack, Equifax, Experian, TransUnion), we receive and process credit report data and credit scores on your behalf and in accordance with the Fair Credit Reporting Act (FCRA).
  • Vehicle data providers: Vehicle specifications, book values, and vehicle history data from providers such as Kelley Blue Book, Black Book, J.D. Power, Carfax, and AutoCheck.
  • Identity verification services: Results from OFAC (Office of Foreign Assets Control) screening and identity verification checks.
  • Third-party integrations: Data exchanged through integrations you enable (CRM systems, lender platforms, inventory marketplaces, communication platform chat widgets, SMS widgets, and other third-party services).

3. HOW WE USE YOUR INFORMATION

We use the information we collect for the following purposes:

Service delivery and operations: To provide, maintain, and improve the Platform; to process your transactions; to manage your account; to provide customer support; and to deliver the features and services you request.

Billing and payments: To process subscription payments, manage billing cycles, send invoices, collect amounts owed, and enforce payment terms.

Communications: To send transactional communications (account confirmations, billing notices, support responses, service updates, security alerts) and, where you have not opted out, marketing communications (product announcements, newsletters, promotional offers). See Section 10 for marketing communication details.

Security and fraud prevention: To detect, investigate, and prevent unauthorized access, fraud, abuse, and other illegal or harmful activity; to enforce our Terms of Use; and to protect the rights, property, and safety of AutoFunds, our Users, and others.

Analytics and product improvement: To understand how the Platform is used; to analyze usage patterns and trends; to develop new features; to improve existing features; and to conduct internal research. We use Google Analytics for this purpose as described in Section 4.

Advertising: To deliver targeted advertisements to you on third-party platforms (such as Facebook and Instagram) based on your interactions with the Platform. We use Meta Pixel for this purpose as described in Section 4. You may opt out of targeted advertising as described in Section 8.

Compliance and legal obligations: To comply with applicable laws, regulations, and legal processes; to respond to lawful requests from government authorities; and to establish, exercise, or defend legal claims.

De-identified and aggregated data: We may create de-identified or aggregated data from information we collect. De-identified and aggregated data is not personal information and may be used for any lawful purpose, including benchmarking, research, product development, and industry analysis.

4. COOKIES AND TRACKING TECHNOLOGIES

4.1 Types of Technologies We Use

We use the following cookies and tracking technologies on the Platform:

Strictly necessary cookies: These cookies are essential for the Platform to function. They enable core features such as authentication, session management, security, and load balancing. You cannot opt out of strictly necessary cookies because the Platform cannot operate without them.

Analytics cookies (Google Analytics): We use Google Analytics to collect information about how Users interact with the Platform. Google Analytics uses cookies to collect information such as how often Users visit the Platform, what pages they visit, and what other sites they used prior to coming to the Platform. We use the information from Google Analytics to improve the Platform. Google Analytics collects the IP address assigned to you on the date you visit the Platform, but does not collect your name or other directly identifying information. Google’s ability to use and share information collected by Google Analytics about your visits is restricted by the Google Analytics Terms of Service and the Google Privacy Policy. You may opt out of Google Analytics by installing the Google Analytics Opt-Out Browser Add-on available at https://tools.google.com/dlpage/gaoptout.

Advertising cookies (Meta Pixel): We use Meta Pixel (formerly Facebook Pixel), a tracking technology provided by Meta Platforms, Inc. Meta Pixel collects information about your interactions with the Platform, including pages visited, actions taken, and device information, and transmits this data to Meta. We use this data for the following purposes:

  • Conversion tracking: To measure the effectiveness of our advertising campaigns on Facebook and Instagram by tracking actions Users take on the Platform after clicking on or viewing our ads.
  • Retargeting: To display targeted advertisements to you on Facebook, Instagram, and Meta Audience Network based on your interactions with the Platform.
  • Lookalike audiences: To create advertising audiences of people with similar characteristics to our existing Users.

The data collected by Meta Pixel is transmitted to Meta and is subject to Meta’s Data Policy (https://www.facebook.com/policy.php). Under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), the transmission of personal information to Meta through Meta Pixel for purposes of cross-context behavioral advertising constitutes “sharing” of personal information. You have the right to opt out of this sharing as described in Section 8.

Advertising cookies (TikTok Pixel): AutoFunds may deploy TikTok Pixel, a tracking technology provided by TikTok Inc. (ByteDance Ltd.), on dealer websites built through the Platform. TikTok Pixel collects information about visitor interactions with dealer websites and transmits this data to TikTok for conversion tracking and targeted advertising purposes. TikTok Pixel is not deployed on autofunds.com. The use of TikTok Pixel on dealer websites is governed by the dealer’s consumer-facing privacy policy. Additional details will be provided in the dealer website privacy policy template.

Chat and communication tools (ChatChasers): We use ChatChasers, a third-party live chat service, on the Platform. When you interact with the chat feature, ChatChasers collects the content of your chat messages, your name and email address (if provided), IP address, browser information, and timestamps. Chat transcripts are stored by ChatChasers and by AutoFunds. ChatChasers’ use of your data is governed by ChatChasers’ own privacy policy.

AutoFunds internal analytics: We use our own proprietary analytics tools to track Platform usage, feature adoption, error rates, and performance metrics.

4.2 Global Privacy Control (GPC)

AutoFunds honors Global Privacy Control (GPC) signals. If your browser or device transmits a GPC signal, we will treat that signal as a valid opt-out request for the sale or sharing of your personal information associated with that browser or device, as required by applicable state law. When we detect a GPC signal, we will disable Meta Pixel and other advertising-related tracking for your session.

You may manage cookies through the following methods:

  • Browser settings: Most web browsers allow you to control cookies through their settings. You can set your browser to refuse all cookies, accept only certain cookies, or alert you when a cookie is set. Note that disabling cookies may affect the functionality of the Platform.
  • Google Analytics opt-out: Install the Google Analytics Opt-Out Browser Add-on at https://tools.google.com/dlpage/gaoptout.
  • Meta opt-out: You may opt out of Meta’s targeted advertising by adjusting your ad preferences in your Facebook/Instagram account settings, or by opting out through the Digital Advertising Alliance’s opt-out tool at https://optout.aboutads.info.
  • GPC signal: Enable Global Privacy Control in your browser. Visit https://globalprivacycontrol.org for more information.

5. HOW WE SHARE YOUR INFORMATION

We do not sell your personal information for monetary consideration. However, as described in Section 4, our use of Meta Pixel constitutes “sharing” of personal information for cross-context behavioral advertising under certain state privacy laws, including the CCPA/CPRA. You may opt out of this sharing as described in Section 8.

We may disclose your information to the following categories of recipients:

5.1 Service Providers

We share information with third-party service providers who perform services on our behalf, including:

  • Cloud hosting and infrastructure: Servers and data storage.
  • Payment processing: Credit card and debit card payment processing.

All service providers are bound by written agreements that impose data protection obligations.
  • Analytics: Google Analytics (see Section 4).

  • Chat and communication services: ChatChasers and other third-party chat widget and SMS widget providers used on the Platform or on dealer websites built through the Platform (see Section 4).

5.3 Consumer Data Processing

When you use the Platform to process Consumer Data (e.g., customer names, SSNs, credit applications), AutoFunds acts as a data processor/service provider on your behalf. We process Consumer Data only as necessary to provide, maintain, and improve the Service, and in accordance with our Terms of Use. We do not use Consumer Data for our own commercial purposes, sell Consumer Data, or share Consumer Data for advertising purposes. Our obligations with respect to Consumer Data are described in Section 6 of our Terms of Use.

We may disclose your information when we believe in good faith that disclosure is necessary to:

  • Comply with applicable law, regulation, legal process, or governmental request.
  • Enforce our Terms of Use or other agreements.
  • Protect the rights, property, or safety of AutoFunds, our Users, or others.
  • Detect, prevent, or address fraud, security, or technical issues.
  • Respond to a lawful request by public authorities, including to meet national security or law enforcement requirements.

5.5 Business Transfers

If AutoFunds is involved in a merger, acquisition, asset sale, bankruptcy, reorganization, or similar business transaction, your information may be transferred as part of that transaction.

6. DATA RETENTION

We retain your information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. Retention periods vary by data type and are determined by:

  • The duration of your account relationship with AutoFunds.
  • Legal and regulatory record retention requirements applicable to financial services platforms, including the Gramm-Leach-Bliley Act (GLBA), Internal Revenue Code, and state-specific dealer record retention laws.
  • The need to resolve disputes, enforce agreements, and establish or defend legal claims.
  • Applicable statutes of limitations.

Consumer Data entered into the Platform is available for export by the Dealer for a period of thirty (30) days following account termination, as set forth in the Terms of Use.

When information is no longer needed for its original purpose and no legal retention obligation applies, we will securely delete or de-identify it. De-identified and aggregated data may be retained indefinitely, as it is no longer personal information.

7. DATA SECURITY

AutoFunds maintains a written information security program designed to protect the confidentiality, integrity, and security of personal information in compliance with the Gramm-Leach-Bliley Act (GLBA) Safeguards Rule (16 C.F.R. Part 314) and other applicable data security requirements. Our program includes administrative, technical, and physical safeguards appropriate to the size, complexity, and sensitivity of the information we process.

All service providers with access to personal information are bound by written data protection agreements and are required to maintain appropriate security measures.

While we implement commercially reasonable security measures, no method of electronic transmission or storage is completely secure. We cannot guarantee the absolute security of your information.

Your Responsibilities. You are responsible for maintaining the confidentiality of your login credentials, using strong and unique passwords, limiting access to your devices and systems, and notifying us immediately at support@autofunds.com if you suspect any unauthorized use of your account.
